What Is Disaster Unemployment Assistance (DUA)?

Disaster Unemployment Assistance (DUA), also referred to as Disaster Relief and Emergency Assistance, is a federal program that provides temporary financial assistance to individuals unemployed as a result of a “major disaster” declared by the president.

On November 12, 2018, a major disaster was declared for parts of California due to the Camp Fire in Butte County, the Hill Fire in Ventura County, and the Woolsey Fire in Los Angeles County and Ventura County. As of November 14, DUA benefits are available to workers in those counties who are displaced from employment due to the wildfires and who do not qualify for regular state Unemployment Insurance (UI). The deadline for filing DUA applications in the three disaster-designated counties (originally December 14, 2018) is now extended to March 15, 2019.

Due to the wildfire disasters, California has waived the normal one-week waiting period for those claiming state UI benefits during the disaster period in Butte, Los Angeles, and Ventura counties and in several other counties covered by declared state fire emergencies.  As a result, UI and DUA benefits can be paid beginning the week of November 11, 2018, for weeks during the disaster period in which a worker is wholly or partially unemployed as a result of the disaster.

Certify for Unemployment Insurance Benefits

Certifying is the process of answering basic questions every two weeks that tells us you’re still unemployed and eligible to continue receiving benefit payments. For help answering these questions, visit Understanding the Certification Questions or review Unemployment Benefit Certification Question Information (YouTube). Answering questions incorrectly can delay your payment.

You will receive your claim package in the mail verifying you are eligible for benefits. You may also receive an email from us notifying you that your registration has been completed in UI OnlineSM. Once you receive this information, it is time for you to certify for your first benefit payment.

Your first certification period begins two weeks after you file for unemployment.

To get started in certifying for benefits:

  1. Log in to Benefit Programs Online.
  2. Follow the instructions in UI Online to complete the steps provided.

After your first benefit payment, you must tell us that you’re still unemployed and eligible to keep receiving benefits. You must do this every two weeks.

As you collect benefits, you will receive notifications in your UI Online account telling you when to take action. You may also receive important email reminders from our online system.

Submit on Time

If you certify early or late, your payment could be delayed or denied. You must tell us that you’re still unemployed and eligible to keep receiving benefits. You must do this every 14 days from the date displayed on your claim form.

We recommend that you certify for benefits with UI Online because it is a fast, convenient, and a secure way to certify.

Report Accurately

By certifying for unemployment benefits, you are declaring by law that you meet the eligibility requirements to collect benefits.

2022 Base Unemployment Insurance Tax Rate for Employers

N.C. Senate Bill 311, signed into law by Governor Roy Cooper on Nov. 10, freezes the base contribution rate to the state’s Unemployment Insurance Trust Fund for experience-rated employers at 1.9% for 2022.

What Is Disaster Unemployment Assistance (DUA)?

Disaster Unemployment Assistance (DUA), also referred to as Disaster Relief and Emergency Assistance, is a federal program that provides temporary financial assistance to individuals unemployed as a result of a “major disaster” declared by the president.

On November 12, 2018, a major disaster was declared for parts of California due to the Camp Fire in Butte County, the Hill Fire in Ventura County, and the Woolsey Fire in Los Angeles County and Ventura County. As of November 14, DUA benefits are available to workers in those counties who are displaced from employment due to the wildfires and who do not qualify for regular state Unemployment Insurance (UI). The deadline for filing DUA applications in the three disaster-designated counties (originally December 14, 2018) is now extended to March 15, 2019.

Due to the wildfire disasters, California has waived the normal one-week waiting period for those claiming state UI benefits during the disaster period in Butte, Los Angeles, and Ventura counties and in several other counties covered by declared state fire emergencies.  As a result, UI and DUA benefits can be paid beginning the week of November 11, 2018, for weeks during the disaster period in which a worker is wholly or partially unemployed as a result of the disaster.

What Are the Basic Eligibility Requirements for DUA?

There are two major requirements for an individual to qualify for DUA: 1) The individual must be out of work as a “direct result” of a major disaster; and 2) The individual does not qualify for regular unemployment insurance (UI) from any state. Once found to be eligible for DUA, workers must actively look for work and accept suitable work offered them, not unlike UI recipients. In addition, the individual must show that for every week he or she is collecting DUA, his or her unemployment continues to be the direct result of the disaster, not other factors.

How Much Are DUA Benefit Payments?

Like UI benefits, DUA benefits are paid weekly, once an application is completed, filed and processed. DUA recipients receive the same weekly benefits that they would have been entitled to had they qualified for UI in the state where they were employed. 2022 Base Unemployment Insurance Tax Rate for Employers

N.C. Senate Bill 311, signed into law by Governor Roy Cooper on Nov. 10, freezes http www edd ca gov ui_online base contribution rate to the state’s Unemployment Insurance Trust Fund for experience-rated employers at 1.9% for 2022.

The base contribution rate is one of the factors used to calculate an employer’s unemployment insurance taxes for the year. The Division of Employment Security will send tax rate notices to employers before Jan. 1, 2022. Learn more at des.nc.gov/employers/tax-rate-information.

What Is Disaster Unemployment Assistance (DUA)?

Disaster Unemployment Assistance (DUA), also referred to as Disaster Relief and Emergency Assistance, is a federal program that provides temporary financial assistance to individuals unemployed as a result of a “major disaster” declared by the president.

On November 12, 2018, a major disaster was declared for parts of California due to the Camp Fire in Butte County, the Hill Fire in Ventura County, and the Woolsey Fire in Los Angeles County and Ventura County. As of November 14, DUA benefits are available to workers in those counties who are displaced from employment due to the wildfires and who do not qualify for regular state Unemployment Insurance (UI). The deadline for filing DUA applications in the three disaster-designated counties (originally December 14, 2018) is now extended to March 15, 2019.

Due to the wildfire disasters, California has waived the normal one-week waiting period for those claiming state UI benefits during the disaster period in Butte, Los Angeles, and Ventura counties and in several other counties covered by declared state fire emergencies.  As a result, UI and DUA benefits can be paid beginning the week of November 11, 2018, for weeks during the disaster period in which a worker is wholly or partially unemployed as a result of the disaster.

What Are the Basic Eligibility Requirements for DUA?

There are two major requirements for an individual to qualify for DUA: 1) The individual must http www edd ca gov ui_online out of work as a “direct 1st corinthians 13 the message of a major disaster; and 2) The individual does not qualify for regular unemployment insurance (UI) from any state. Once found to be eligible for DUA, workers must actively look for work and accept suitable work offered them, not unlike UI recipients. How Much Are DUA Benefit Payments?

Like UI benefits, DUA benefits are paid weekly, once an application is completed, filed and processed. DUA recipients receive the same weekly benefits that they would have been entitled to had they qualified for UI in the state where they were employed. However, at a minimum, DUA benefits cannot be less than one-half of the state’s average weekly UI benefits. In California, the average weekly UI benefit is $326.70, the minimum weekly DUA benefit is $164, and the maximum weekly benefit for DUA and UI is $450 (see the state maximum and minimum DUA benefit levels below).

The DUA benefits for part-time workers are pro-rated based on the hours they worked as a percent of a 40-hour work week. Note that DUA benefits are reduced by any other wage-loss compensation, including private insurance, Supplemental Unemployment Benefits, worker’s compensation, and a pro-rated amount of a retirement pension or annuity.

How Long Will an Individual’s DUA Benefits Last?

The maximum duration of DUA benefits is 26 weeks. However, an individual’s benefits cannot extend beyond the period when the disaster officially ends, which is six months from the date the federal disaster was declared. In the case of California, that means the DUA benefits cannot extend beyond May 2019 (unless the deadline is extended by Congress). In addition, the DUA benefits cannot extend beyond when the recipient returns to work or self-employment or beyond the period when the individual’s unemployment is no longer directly related to the disaster.

Those who may be eligible for DUA and typically could not collect regular state UI benefits include:

  • Self-employed people who lost their business or suffered a substantial interruption of activities as a direct result of a major disaster;
  • Workers whose place of employment was damaged due to the disaster and work is not available;
  • Workers who cannot reach their employment as a result of the disaster;
  • Workers unemployed as a result of an injury caused as a direct result of the disaster;
  • People who are scheduled to start work but became unemployed because they no longer have a job as a direct result of a disaster.

Are Workers Who Did Not Work in the Disaster Area Also Eligible for DUA if Their Unemployment Was Still Directly Caused by the Disaster?

There are limited situations where workers outside the disaster area can qualify for DUA if they were laid off due to their employer’s loss of substantial revenue from contracts with businesses located in the disaster area. However, according to the federal regulations, the employer or self-employed individual must have received at least a “majority of its revenue or income from an entity that was either damaged or destroyed in the disaster.” In addition, the individual must continually establish that his or her unemployment remains directly related to the major disaster.

What Are the Deadlines to Apply for DUA?

To qualify for DUA, individuals must normally apply no later than 30 days after the availability of DUA was officially announced by the state. As of December 14, 2018, the deadline for DUA applications from workers in Butte, Los Angeles, and Ventura counties is extended to March 15, 2019. Late applications can be accepted, but only if “good cause” is shown for the late filing. However, under no circumstances can DUA applications be accepted after the disaster period ends.

What Information Is Necessary to Verify an Applicant’s Work and Earnings?

The DUA application requires proof of employment and earnings, as well as a Social Security Number. The proof of employment is due no later than 21 days after the application is filed with the state. For self-employed applicants, copies of tax returns are required as proof of income and self-employment. If verification of employment or other documents requested as part of the DUA application are not available, a sworn statement including other forms of verification can be submitted. Interim DUA payments can take place while the necessary documentation is gathered. California Unemployment Benefits

Unemployment Insurance (UI) in California is an initiative taken up jointly by the state and the federal government. The purpose of this initiative is to provide financial support to those who have lost their jobs due to reasons beyond their control.

Eligibility to Apply for UI Benefits in California

Monetary Eligibility

While applying for Unemployment benefits in California, applicants must first meet the monetary eligibility requirements. The base period is a 12-month period, which is divided into four quarters. EDD has designed two types of base periods to calculate wages to establish a claim. They are:

  • Standard Base Period
  • Alternate Base Period

A standard base period is the first four of the last five calendar quarters. In this method of calculation, the quarter prior to which you apply for benefits is not considered, but four quarters prior to this is considered.

For example, if an applicant claim begins in the first quarter of 2019 (i.e. Jan, Feb, and March), the base period will consist of the following quarters – Oct-Nov-Dec 2017, Jan-Feb-Mar 2018, Apr-May-June 2018, and Jul-Aug-Sep 2018. Note that Oct-Nov-Dec 2018 will not be considered as a part of the standard base period.

In the event the applicant does not have sufficient wages in his or her standard base period, EDD will then consider calculating his or her wages using the alternative base period. The alternative base period consists of the last four calendar quarters prior to the beginning date of the claim.

For example, if the claim begins in the first quarter of 2019, (i.e. Jan, Feb, and March), the alternative base period will consist of these quarters – Jan-Feb-Mar 2018, Apr-May-June 2018, Jul-Aug-Sep 2018, and Oct-Nov-Dec 2018.

The alternative base period can only be considered when the applicant does not have enough wages in his or her standard base period, but has sufficient wages in the alternative base period.

Job Separation

Once the monetary eligibility is established, the step for qualification will be to prove that the applicant lost his job due to no fault of his or her own. The applicants must meet the below-mentioned criteria to meet the job-separation criteria:

  • The applicant must not lose the job through their fault
  • The applicant was not involved in any illegal, criminal, or unethical activities in his or her workplace, which resulted in you getting fired
  • The applicant was fired or work time was decreased due to lack of work
  • The applicant did not quit the job due to lack of interest

Please note that not all those who are unemployed will be eligible for Unemployment Insurance. The benefits are given to only those who meet all the eligibility criteria set by EDD.

EDD will verify the reason given by the applicant for separating from your previous organization. It will contact your ex-employer to verify the reason given by the applicant. If any discrepancies are found, the applicant’s eligibility will be affected.

Things to Know After Filing An Application

Once the application is filed, the claimant will begin to receive the benefit amount every week. There is a need for the claimants to be aware of all the rules and regulations imposed on them throughout the benefit period. Overpayments and Fraud

Overpayments arise when the applicant receives benefits which he or she was not entitled to. If in case the applicant draws overpayments from EDD, he or she will receive a Notice of Overpayment via mail.

The Notice of Overpayment will contain information on the nature of overpayment that is drawn by the applicant, the amount to be paid back to EDD and penalties levied (if any). It will also contain information on the applicant’s right to appeal against the imposition of overpayment, and about the procedure to appeal.

The EDD has classified overpayments into two categories – Non-Fraud and Fraud.

Non-Fraud: If you received a payment which the applicant was not entitled to, but not intentionally or not as a result of his or her fault, it will be considered as a non-fraud overpayment. In such a case, the applicant will receive a notice stating that he or she received an overpayment and the excessive amount needs to be paid back. However, In some exceptional cases, the applicant may not be asked to repay the excessive amount. 

There will be no penalties or interest levied on the applicants in the case of non-fraud overpayment.

Fraud: A fraud overpayment occurs when the applicant intentionally misleads the EDD into paying more benefits than he or she was entitled to. If the applicant withholds an important piece of information, lies about his or her earnings during the base period, gives false or fake documents to prove eligibility, fails to disclose information of wages earned during the benefits weeks and similar misleading tactics are considered as a fraud in the state of California.

If a fraud overpayment case is established, the applicant will be expected not only to pay back the excessive amount but also pay a penalty of 30% of the amount of the overpayment. He or she may also face disqualification from anywhere between 5 weeks to 23 weeks.

If the applicant fails to repay the excessive amount along with the stipulated fine amount, the EDD may deduct the money from his or her future weekly unemployment benefits amount, which is referred to as an offset.

As a policy of offset, the EDD may also deduct from or totally withhold the applicant’s state income tax refunds, lottery winnings, or any other source of income owed by the state. The EDD may also file a case against the applicant in a court of law, charge him or her court costs and interest, and record a lien on his or her property.

The economic impact of the coronavirus crisis in California – the worst affected state in the US where the number of cases exceeded 800,000 recently – has put hundreds of thousands of residents out of work.

And the resultant surge in unemployment claims over the past few months has overwhelmed the state’s Employment Development Department (EDD), meaning claimants will likely have to wait much longer than usual for their claims to be processed.

The situation reached boiling point last weekend when the EDD announced that it would put a halt on accepting new unemployment claims for a period of two weeks as it looks to reduce its massive backlog.

Certify for Unemployment Insurance Benefits

Certifying is the process of answering basic questions every two weeks that tells us you’re still unemployed and eligible to continue receiving benefit payments. For help answering these questions, visit Understanding the Certification Questions or review Unemployment Benefit Certification Question Information (YouTube). Answering questions incorrectly can delay your payment.

You will receive your claim package in the mail verifying you are eligible for benefits. Your first certification period begins two weeks after you file for unemployment.

Report Accurately

By certifying for unemployment benefits, you are declaring by law that you meet the eligibility requirements to collect benefits.

If you withhold or give false information to receive benefits, such as not reporting work or wages, you are committing fraud. Penalties may include disqualification for unemployment insurance, losing your benefits, and criminal prosecution.
